The Lucknow bench of the Allahabad High Court on Friday directed the registration of an FIR against Congress MP and Leader of Opposition Rahul Gandhi in connection with an alleged dual citizenship controversy.
Justice Subhash Vidyarthi passed the order while hearing a petition filed by S. Vignesh Shishir, a BJP worker from Karnataka, who had sought an FIR and investigation into the matter.
The Court also observed that once the FIR is registered, the state government may consider involving a central agency for further investigation.
Petition and Earlier Court Proceedings
The case stems from a complaint first filed before a special MP/MLA court in Rae Bareli, which had earlier rejected the plea for registration of an FIR against Gandhi. The court had stated that it was not competent to decide issues related to citizenship.
Following this, the petitioner approached the High Court after the matter was transferred to Lucknow on December 17, 2025. The MP/MLA court in Lucknow later dismissed the plea on January 28, 2026, leading to the fresh petition before the High Court.
Allegations Raised in the Case
The petitioner alleged that Rahul Gandhi holds dual citizenship and sought criminal action under multiple laws, including the Bharatiya Nyaya Sanhita, the Foreigners Act, the Passport Act, and the Official Secrets Act.
He requested a detailed probe and registration of an FIR based on these claims.
Court’s Direction
After hearing the matter, the High Court directed that an FIR be registered, allowing investigative agencies to proceed with the case in accordance with law.
The Court also stated that the government may seek assistance from a central agency if required during the investigation.
