A special fast-track court in Uttar Pradesh’s Budaun district has convicted a man in a kidnapping, rape and alleged forced religious conversion case, sentencing him to 10 years of rigorous imprisonment and imposing a fine of ₹1 lakh.
According to the court’s order, the accused, Sakir Hussain, a resident of Risauli, was also sentenced under the Uttar Pradesh Prohibition of Unlawful Religious Conversion Act to five years of rigorous imprisonment and a fine of ₹50,000. Judicial sources said this is the first conviction and sentencing under the Act in Budaun district.
Case Details
The case dates back to May 27, 2025, when the husband of a woman from a village in Bilsi police station area lodged a complaint alleging that Sakir Hussain had lured away his wife and their 10-year-old daughter.
Police registered a kidnapping case and launched a search. About eight days later, during a police operation, the accused allegedly abandoned the woman and her daughter on the roadside and fled.
Allegations of Rape and Forced Conversion
In her statement before the court, the woman alleged that the accused took her and her daughter to a house in Kasganj district’s Sidhpura area, where they were confined.
She alleged that the accused repeatedly raped her after threatening to kill her daughter. The woman also claimed that she was pressured to offer namaz and convert her religion.
Investigation
Based on the survivor’s statement and evidence collected during the investigation, police added charges of rape, wrongful confinement, assault, criminal intimidation and offences under the Uttar Pradesh Prohibition of Unlawful Religious Conversion Act.
The accused was arrested and sent to jail. After completing the investigation, police filed a chargesheet before the special fast-track court.
Court Verdict
Special Judge (Fast Track Court/Women’s Crimes) Neha Garg convicted Sakir Hussain after considering the evidence, witness testimonies and arguments presented by both sides.
The court sentenced him to a total of 10 years of rigorous imprisonment and imposed a fine of ₹1 lakh under various provisions of law.
Additionally, under Sections 3 and 5(1) of the Uttar Pradesh Prohibition of Unlawful Religious Conversion Act, the court awarded five years of rigorous imprisonment and a ₹50,000 fine. In default of payment of the fine, the accused will undergo an additional three months of simple imprisonment.
The court directed that all sentences will run concurrently, and the period already spent in judicial custody will be set off against the sentence.
