Madhya Pradesh HC Orders Muslim Man to Salute National Flag and Chant “Bharat Mata ki Jai” in Pro-Pakistan Slogans Case

The Madhya Pradesh High Court granted bail to Faizal, also known as Faizan, who was accused of shouting the slogan “Pakistan Zindabad, Hindustan Murdabad.” The bail was granted under a unique condition that he must salute the National Flag 21 times while raising the slogan “Bharat Mata ki Jai,” twice a month. This condition was imposed by Justice Dinesh Kumar Paliwal, who noted that it might inspire in him a sense of responsibility and national pride.

Faizan, who was charged under Section 153A of the IPC (promoting enmity between different groups), was ordered to mark his presence at Misrod Police Station, Bhopal, on the first and fourth Tuesday of each month between 10 AM and 12 PM, where he must perform the flag salute as per the court’s instructions. The court also directed the Police Commissioner of Bhopal to ensure compliance with this condition.

Faizan’s bail is subject to several conditions, including furnishing a bond of ₹50,000, and it will remain effective until the trial concludes. The court warned that any violation of the bail conditions would render the order ineffective.

“…he shall continuously mark his presence before Police Station Misrod, Bhopal between 10 A.M. to 12 ‘O’Clock of the day on every 1st and 4th Tuesday of month till final conclusion of trial and shall salute the National Flag unfurled on the building of police station 21 (twenty one) time raising slogan “Bharat Mata ki Jai”. Aforesaid condition has to be necessarily incorporated in bail papers,” Court’s order reads which also directs him to furnish a bond of Rs. 50,000/-.

During the hearing, Faizan’s counsel argued that while the video showed Faizan shouting the anti-national slogan, he had been falsely implicated. However, the state’s counsel opposed the bail request, saying Faizan had a history of criminal cases and the anti-India slogans seen in the video. Despite this, the court decided to release him on bail while imposing these strict conditions.
