Delhi High Court Shields Rights Activist Nadeem Khan From Arrest In Conspiracy Case

The Delhi Court on Wednesday offered protection to National Secretary of the Association for Protection of Civil Rights (APCR) Nadeem Khan from arrest in a case booked by Delhi police on charges of promoting enmity and criminal conspiracy.

Two petitions were filed by Nadeem seeking a stay on the investigation and the cancellation of FIR against him claiming that he was promoting enmity, committed acts that disrupt harmony, public mischief and criminal conspiracy. 

Senior Advocate Kapil Sibal represented Khan and argued that police must not harass Khan in the name of investigation. He further objected to the police’s demand to take Khan’s phone stating that it was an attempt to check everything he did in his life. Advocate Sibal affirmed that Khan would cooperate with the investigation if done promptly and called for a quick end to the broad investigation led by the police. 

Earlier the court had granted interim relief from arrest to Khan. 

Justice Jasmeet Singh noted and said, “They (police) are entitled to investigate and they are investigating. Your right to liberty is protected and you will not be arrested. He ordered that if the police want his custody, a notice must be sent seven days prior. 

Nadeem was booked after APCR organised a program against the “anti-Muslim violence in the country.”
