The bail granted to three men accused of assaulting an elderly man on a train in Maharashtra’s Nashik has been revoked by a court. The accused were arrested for attacking an elderly person on suspicion of carrying beef.
The court cancelled the bail after the GRP included a non-bailable section of the Bharatiya Nyaya Sanhita in the case. The GRP on Monday added two more sections, one for uttering words intended to hurt religious sentiments, and another for robbery or dacoity with an attempted act to cause death or grievous hurt. The second provision is non-bailable.
The GRP filed an application with the Kalyan railway court on Monday, requesting the cancellation of the accused men’s bail. The court determined that the presence of the accused men was essential for further investigation and thus cancelled their bail.
Jitendra Awhad, a leader of the Nationalist Congress Party (Sharadchandra Pawar), shared a copy of the order on social media. He had met with the railway police on Sunday to inquire why they had not taken action independently after a video of the assault went viral.
In response, the Government Railway Police (GRP) has initiated an operation to locate the trio and re-arrest them.
The elderly man Hussain, the victim, was travelling from Jalgaon, Maharashtra, to Kalyan to visit his daughter. He claims that the attack on him during the train journey was unprovoked.
According to police, Hussain told that while the train was crowded, he was standing until the train approached Nashik railway station. At that point, a young girl sitting in the upper berth got up, and he occupied her seat.
A young man in his mid-twenties, standing next to Hussain, asked him to make space. Since there was no room for another person, Hussain jokingly asked him if he planned to sit on his lap. This angered the young men who were on their way to Mumbai for a police recruitment exam.
When the train arrived at Kalyan station, Hussain attempted to retrieve his bag, which contained two plastic jars of buffalo meat. Consuming water buffalo meat is legal in Maharashtra. However, the men demanded that he open his bag and show its contents. They started surrounding him, asking what he had in the bag.
Feeling harassed and anxious, Hussain claimed that it was bullock meat (which has been banned in Maharashtra since 2015). In response, the men began physically assaulting him and hurling verbal abuse. Hussain recalls hearing some of them suggest throwing him out of the moving train.
Despite resisting the attack, the elderly man was repeatedly struck, particularly in his eyes and chest. Hussain told that the men not only threatened to kill him but also vowed to sexually assault the women in his family if he reported the incident to the police.
According to reports from The Wire and The Quint, the men boasted about their alleged affiliation with the Hindutva group Bajrang Dal. This group has frequently been accused of involvement in cow vigilantism and mob lynching on multiple occasions.
A video capturing the incident went viral on social media, leading to the arrest of three men from Dhule – Akash Awhad (30), Nitesh Ahire (30), and Jayesh Mohite (21) – on August 31. The trio was presented in court the following day and granted bail. Since the GRP was unable to keep them in custody after their release, the accused were allowed to return home.
Upon receiving additional information from the victim, the police added charges of dacoity and hurting religious sentiments to the case. They then requested that the bail be cancelled, a plea the court granted on Monday. This led to the re-arrest of the three accused in this case.
The police has been deployed outside their residences. However the accused have not yet been apprehended, since their release. The official stated that the GRP is making efforts to apprehend all individuals involved in the case.
Investigating officer Archana Dusane informed The Times of India that the railway police have identified two more individuals from Dhule district in Maharashtra who will be arrested soon.
