A Delhi court has allowed former Aam Aadmi Party councillor Tahir Hussain to use an electric kettle and a wooden takhat inside jail on medical grounds.
Additional Sessions Judge Sameer Bajpai passed the order while hearing Hussain’s plea in the case related to the alleged larger conspiracy behind the 2020 North East Delhi riots.
Court Relies on Medical Records
Hussain’s lawyer told the court that he suffers from several medical conditions and needs regular access to hot water. The lawyer said an electric kettle was required to help manage his health during his incarceration.
The defence also sought permission for Hussain to use a wooden takhat, saying both items had previously been permitted on the recommendation of specialist doctors and jail authorities.
According to Hussain’s plea, he had been using the electric kettle and wooden takhat for around five years and wanted to continue using them.
After examining the medical documents submitted by Hussain, the court allowed the application.
“In view of the medical papers shown by the accused and the prayer made by him, the application is allowed,” the court said.
The judge directed that Hussain may use the electric kettle and wooden takhat “as per the jail rules” and instructed the concerned jail superintendent to comply with the order.
Bail Plea Pending Before Delhi High Court
Hussain was denied bail by the trial court on January 29. His bail application in the UAPA case is currently pending before the Delhi High Court.
He is among several people accused in a case alleging a larger conspiracy behind the communal violence in North East Delhi in February 2020.
The accused face charges under the Unlawful Activities Prevention Act and other criminal laws. The prosecution alleges that the accused were involved in planning the violence, while the allegations remain subject to judicial proceedings.
The case includes several activists who were involved in protests against the Citizenship Amendment Act in 2019 and 2020.
