The Delhi High Court has granted three days of custody parole to Habib Ur Rehman alias Habib, an accused in a terror case under the Unlawful Activities (Prevention) Act (UAPA), allowing him to attend his daughter’s wedding in Mumbai.
A division bench of Justice Prathiba M Singh and Justice Madhu Jain passed the order on May 29, permitting Habib to remain out on custody parole from May 30 to June 1. His daughter’s wedding is scheduled for May 31.
Habib is an accused in a 2017 case registered by the National Investigation Agency and has been in judicial custody for nearly eight years.
Court Cites Daughter’s Marriage as Reason for Relief
While granting the temporary relief, the bench noted the personal nature of the request and said the parole was being allowed so Habib could attend an important family event.
“Considering the fact that it is the Appellant’s daughter who would be getting married, the Court grants custody parole to the Appellant for the period from 30th May, 2026 till 1st June, 2026 to enable him to attend the marriage of his daughter in Mumbai,” the bench said in its order.
However, the court imposed strict conditions on his movement during the parole period.
Strict Conditions Imposed During Custody Parole
The High Court directed that Habib would only be allowed to travel between his residence and the marriage venue in Mumbai. He has been barred from visiting any other location.
The bench also ordered the jail authorities to assign two police personnel to accompany him throughout the parole period.
“The said two police officials shall be in plain clothes,” the court said, adding that Habib would be brought back to Delhi immediately after the parole period ends.
State to Bear Custody Expenses
The court also took note of Habib’s financial condition, observing that he was unable to bear the cost of custody parole arrangements after spending nearly eight years in jail.
Accordingly, the bench directed the state to cover the expenses of the police escort and related arrangements.
Habib was represented by advocates Aarif Ali and Nishant Singh, while advocate Rahul Tyagi appeared for the NIA.
Regular Bail Plea Pending
Habib Ur Rehman’s regular bail plea remains pending before the High Court and is scheduled to be heard on July 6.
He had challenged a November 12, 2025 order of the NIA Special Court in New Delhi, which rejected his bail application.
During the hearing, questions were raised over whether an interim bail request could be considered while a regular bail plea was already pending. However, the High Court granted custody parole by invoking its inherent powers, according to his counsel.
